Terms of Service

The practical rules for using NWatch safely and fairly.

1. Agreement and service operator

These Terms govern your use of the NWatch mobile app, manager portal, websites and related support (the "Service"). NWatch is operated by Robert Evans (ABN 94 037 705 984) under the RME Solutions Technology brand ("NWatch", "we", "us" or "our"). By creating or using an account, joining a group, managing a group or purchasing a licence, you agree to these Terms and our Privacy Policy.

If you use the Service for an organisation, you confirm that you have authority to act for it. If you do not agree, do not use the Service.

2. Safety and emergency services

NWatch does not contact emergency services and is not a replacement for your local emergency number. If life, health or property is in immediate danger, call your local emergency number first, then alert your group if it is safe to do so.

The Service helps a trusted group share urgent alerts. It does not provide professional monitoring, dispatch, medical advice, police services, security services or a guaranteed response. Group members are responsible for deciding how to respond safely and lawfully.

3. Accounts and sign-in

NWatch supports Google, Microsoft when enabled, Apple on iOS, and passwordless email links for sign-in. Email links are one-time and secure, not numeric OTPs; NWatch does not issue an NWatch password.

  • You must provide accurate information through a supported Google, Apple or Microsoft account and keep that identity secure.
  • You must not share an account, impersonate another person or bypass access controls.
  • You are responsible for activity under your account and should notify us promptly if you believe it is compromised.
  • You must be at least 13 years old to create or use an NWatch account. If you are 13 to 17, you must have permission and appropriate supervision from a parent, guardian or authorised organisation.

Deleting an identity-provider account does not necessarily delete the NWatch account. Use the in-app deletion control or the web deletion request.

4. Trusted groups and manager responsibilities

Membership is invitation-based. A group manager chooses the group name and zone, controls invites, assigns managers, moderates membership, maintains the licence and may view operational history for that group.

Managers must:

  • invite only people who belong in the group and explain the group's purpose;
  • protect invite codes, remove people who should no longer have access and keep at least one active manager;
  • use proportionate group sizes and zones so an alert reaches relevant people without creating unnecessary alarm;
  • respond fairly to misuse and avoid representing NWatch as a police, medical or monitored-security service;
  • obtain any organisational authority or member notice required for the way they operate the group.

When a group is no longer operating, a manager may archive it. Archiving stops new alerts, joins, invitations and membership changes while retaining the group, licence, membership and incident records for safety, audit, support and recovery. It is not an automatic deletion process, and ordinary manager surfaces do not permanently erase a group.

Managers do not act as our agents. We may provide super-admin support, enforce limits and investigate safety or security issues.

5. Acceptable use

You may use NWatch only for lawful safety, emergency, duress and related group-management purposes. You must not:

  • send a knowingly false, malicious, discriminatory, harassing or repeatedly non-urgent alert;
  • use alerts to stalk, monitor, threaten or expose another person's location;
  • upload unlawful content or include unnecessary sensitive information in an alert;
  • probe, disrupt, reverse engineer or circumvent the Service, rate limits, licensing or encryption controls except as allowed by law or our written security-testing permission;
  • resell or operate the Service outside the agreed entitlement without our permission.

Report immediate misuse to the group manager. Report serious safety or security concerns to [email protected].

6. Alert delivery limitations

NWatch uses high-priority notifications, an Android alarm channel and, where Apple has granted the entitlement and the user allows it, iOS Critical Alerts. Delivery and audible behaviour still depend on network coverage, push services, battery and background restrictions, device volume and permissions, operating-system settings, app version, valid encryption keys and the recipient's device state.

You should run the in-app emergency-alert readiness check and test the group before relying on it. We monitor delivery diagnostics because silent failure matters, but we cannot guarantee that every alert will be delivered, displayed, decrypted, heard or acted on within a particular time.

7. Subscriptions, seats, renewal and cancellation

Group managers or enterprise customers maintain the licence. Unless a written enterprise agreement says otherwise:

  • self-serve prices are shown in the applicable local currency for the billing interval and seat capacity; taxes are shown at checkout where applicable, and the final customer total is displayed before payment;
  • an eligible new self-serve customer may be offered a 30-day card-required trial only when the confirmation shows no charge today, the exact first-charge date and amount in the selected currency, and the renewal interval; unless cancelled online before that date, the selected subscription is charged and renews automatically at the displayed interval;
  • subscriptions renew automatically at the displayed interval until cancelled;
  • Stripe processes payment and stores payment-card details; Checkout identifies the seller and card-statement descriptor before payment;
  • live self-serve enrolment is made available only after Manage billing has been verified for online cancellation, and every live self-serve customer can use it to cancel future renewal; the paid entitlement normally remains available until the end of the current billing period;
  • adding seat packs creates a Stripe proration adjustment for the remaining billing period; before you confirm, the portal must show the exact prorated amount, whether it is a charge or credit, and how and when it will be collected;
  • failed, reversed or cancelled payments may cause a licence to enter a grace period or expire, which can prevent new alerts until billing is resolved.

Archiving a group does not cancel its Stripe subscription. Ordinary cancellation through Manage billing stops future renewal and normally preserves access through the paid period. By contrast, confirming Delete account in the app attempts to cancel active self-serve subscriptions and end their entitlements immediately; unused time is not automatically refunded. Enterprise or manually provisioned entitlements may need a support-assisted transfer or closure. Any refund, replacement or other remedy is assessed under the mandatory consumer rights that apply where you live, including the Australian Consumer Law, New Zealand Consumer Guarantees Act and applicable US or Canadian law; nothing in these Terms excludes or limits a right that cannot lawfully be excluded. Contact [email protected] with the invoice reference before deletion if you need a transfer or refund reviewed.

8. Privacy, alert content and security

Our Privacy Policy explains the information we collect and the service recovery envelope used for authorised, audited incident recovery. You retain ownership of content you submit, but give us the limited permission needed to encrypt, transmit, store, re-wrap, display and otherwise process it to operate and secure the Service.

We use service providers including Firebase/Google, Cloudflare, Stripe, Apple and Microsoft. Those providers may process information in the countries where their services and support operate, including the United States, rather than in the country where you live. The Privacy Policy should be read for the current processor list, purposes, safeguards and retention details.

If you have a privacy concern, contact [email protected] first. You may also contact the relevant regulator: the Australian OAIC, New Zealand Privacy Commissioner, Office of the Privacy Commissioner of Canada, or the relevant US state regulator or US Federal Trade Commission, depending on your location and the issue.

Do not submit information you are not authorised to share. Keep device and identity-provider security enabled, and install supported updates promptly.

9. Service changes and availability

We may maintain, update or change the Service to improve safety, security, legal compliance or product functionality. We will take reasonable care with compatibility and material changes, but may act immediately where a vulnerability, abuse pattern or platform requirement makes that necessary.

Third-party services such as mobile networks, Apple, Google, Microsoft, Firebase, Cloudflare and Stripe are outside our direct control. Planned and unplanned interruptions can occur.

10. Intellectual property

NWatch, its software, branding, documentation and service design are owned by us or our licensors. We grant you a limited, revocable, non-exclusive and non-transferable right to use the Service for its intended purpose while you comply with these Terms. Open-source components remain subject to their own licences.

11. Consumer rights, warranties and liability

Nothing in these Terms excludes, restricts or modifies a consumer guarantee, remedy or liability that cannot lawfully be excluded, including rights under the Australian Consumer Law.

To the extent permitted by law, the Service is provided with the availability and functionality described here, without a promise that it will be uninterrupted or suitable as your only emergency communication channel. We are not responsible for a failure caused by an unavailable network or third-party platform, disabled device permission, unsupported device state, a group's response, misuse, or information supplied by another user.

Where liability can lawfully be limited, our liability for a failure to comply with an applicable service guarantee is limited, at our option, to supplying the affected service again or paying the reasonable cost of having it supplied again. This limitation does not apply where it would be unfair or unlawful, or to liability that cannot be limited.

12. Suspension, group closure and termination

A manager may pause or remove a member in accordance with the group's safety needs. We may suspend or terminate access where reasonably necessary to address misuse, fraud, non-payment, security risk, legal requirements or danger to others. Where practicable, we will explain the reason and available review path.

You may stop using the Service at any time. To end the account and associated active data, follow Account deletion. Managers must resolve group handover and billing first.

13. General terms and contact

These Terms, the Privacy Policy and any applicable enterprise order form are the agreement about the Service. An enterprise agreement prevails to the extent of a stated conflict. If part of these Terms is unenforceable, the remaining parts continue. A delay in enforcing a right is not a waiver.

Australian law and the laws of the applicable Australian State or Territory govern these Terms, without removing any mandatory rights you have where you live.

We may update these Terms for product, safety, provider or legal changes. We will update the effective date and give additional notice of material changes where appropriate. Questions can be sent to [email protected].
